Welcome! These Terms of Service ("Terms") govern your access to and use of mobile applications, games, websites, and related services (collectively, the "Services") provided by Electric Bear Gaming LLC ("we," "us," or "our").

By downloading, installing, accessing, or using any of our mobile applications or games (each an "App"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. License to Use

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and use our Apps on compatible mobile devices for your personal, non-commercial use.

2. In-App Purchases, Subscriptions & Virtual Goods

Our Apps may offer virtual items, features, consumable items, or auto-renewing subscriptions ("Subscriptions") available for purchase using real-world currency ("In-App Purchases").

• Subscriptions & Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless canceled at least 24 hours before the end of the current period. Your store account (Apple ID or Google Play) will be charged for renewal within 24 hours prior to the end of the current period.

• Subscription Management & Cancellation: You can manage or cancel your Subscriptions at any time through your device's account settings (Apple App Store Subscriptions or Google Play Subscriptions). Discontinuing or uninstalling an App does not automatically cancel your Subscription.

• License Right Only: Virtual items, features, and subscription access are licensed, not sold. You acquire a limited, personal, revocable license to access these features within the applicable App.

• No Real-World Value: Virtual items and currency have no monetary value outside of our Apps and cannot be transferred, sold, or redeemed for real money, physical goods, or services.

• Final Sales & Refunds: All In-App Purchases and Subscription payments are final and non-refundable, except as required by law or store platform policies. Payments and refunds are processed entirely by Apple or Google and are subject to their respective terms.

• Modifications: We reserve the right to modify, adjust, or discontinue virtual items, features, subscription offerings, or pricing at any time.

3. User Data, Storage & Content Disclaimers

Certain Apps may allow you to create, input, edit, store, or sync temporal data, content, or lists (such as shopping lists, notes, or local preferences) ("User Content").

• No Guarantee of Data Safety or Backup: User Content may be stored locally on your device or synced via third-party cloud utilities (such as Apple iCloud or Google Drive). We do not guarantee, warrant, or represent that your User Content will be safely stored, uncorrupted, or free from data loss.

• Temporary Nature of Data: You acknowledge that our Services are not intended to serve as a secure or permanent backup solution. You are solely responsible for maintaining backup copies of any critical information outside of our Apps.

• No Liability for Loss: We are not responsible or liable for any lost, missing, deleted, corrupted, or inaccessible User Content, save data, or app progress resulting from app updates, device changes, OS updates, factory resets, local storage corruption, or server disruptions.

4. Code of Conduct

When using our Services, you agree not to:

• Reverse engineer, decompile, modify, disassemble, or hack any part of our Apps.

• Exploit bugs, glitches, or automated tools (bots, cheats, or memory editors) to manipulate gameplay, features, or purchases.

• Use our Services for any illegal purpose or in violation of applicable local, state, national, or international laws.

5. Intellectual Property

All rights, title, and interest in and to our Services—including app concepts, titles, code, design, artwork, audio, visual elements, logos, and trademarks—are owned exclusively by Electric Bear Gaming LLC.

6. Termination

We reserve the right to suspend or terminate your access to any or all of our Services at our sole discretion, without prior notice or liability, if you breach these Terms. Upon termination, your license to use the Apps immediately ceases, and any active Virtual Goods, data, or progress will be forfeited.

7. Disclaimer of Warranties

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. We explicitly disclaim all warranties regarding data safety, data retention, continuous availability, uninterrupted access, or error-free operation.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Electric Bear Gaming LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of data, loss of content, or lost profits—arising out of or related to your use of, or inability to use, our Apps, Subscriptions, or In-App Purchases.

9. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted at this URL with an updated "Last Updated" date. Your continued use of our Apps following any changes constitutes your acceptance of the updated Terms.
